At Milestone Cricket, your satisfaction and experience are our foremost priority. We take great pride in offering premium products and exceptional service. We understand that occasionally, situations may arise where a product breaks, tares, dents or disintegrates unjustifiable. Rest assured, we've designed a comprehensive plan to address your concerns promptly and effectively. Our commitment revolves around putting your cricket priorities first, ensuring a seamless experience and your peace of mind.
DEFINITIONS
Softs Refund Policy Identification: This text represents the Softs Refund Policy of Milestone Cricket and will be referenced hereafter as "the Policy" or the “Refund Policy” throughout this document.
Identification of Milestone Cricket: Milestone Cricket Pty Ltd, bearing incorporation number 2020/832368/07, is herein referred to interchangeably as "Milestone Cricket" or simply "Milestone."
Definition of "Client": The term "client," as used within this policy, encompasses individuals to whom this document applies, including past, present, and potential clients. It also extends to any individual, entity, corporation, or party accessing or viewing the website. Singular references within this document include the plural form, and gender-specific terms encompass all genders.
THE 5 CORNERSTONES OF THE POLICY
We approach breakages with a commitment to flexibility and expedient service, offering a range of solutions tailored to the scenario. Four distinct options are available, and we meticulously assess each case, determining the most appropriate solution, given the facts.
1. Refund the Product
In instances where breakage is severe or significant, rendering the product irrecoverable or beyond repair, Milestone commits to replacing the product entirely. Our aim is to provide an exact model or an equivalent of the product, prioritizing an identical match unless stock availability poses a challenge. Should stock be unavailable, we ensure an alternative, which could include a new model, a product from a different range, or a demo product serving as a suitable replacement. There are no additional costs or courier fees associated with this option.
2. Repair the Product
For minor issues capable of comprehensive repair, Milestone undertakes the responsibility to restore the product to a functional state, ensuring its usability and performance for matches. While the product may not be in brand-new condition, our repairs guarantee a product in good shape, preparing it for game readiness. No extra costs or courier fees are charged for this service.
3. Interim Replacement for Usage
Milestone offers an interim product to meet your needs during the replacement process or while the broken product undergoes repair. This interim product remains the property of Milestone but is made available for ordinary use by the client until the replacement or repair process concludes. Courier fees related to the interim product are the client's responsibility, while there are no costs associated with the product being replaced or repaired.
4. Voucher
In cases where other options are impractical or insufficient given the circumstances, Milestone may issue a voucher to compensate for the breakage. The value of the voucher can vary, encompassing the entirety or a partial portion of the retail price, contingent on the wear and tear of the product up to that point.
5. Freedom of Rectifying Breakages
We acknowledge that unique situations may arise where the predefined options in this policy might not entirely address the specific circumstances. Therefore, both Milestone Cricket and the client retain the authority to mutually waive any and all provisions outlined in this policy. In doing so, we are empowered to collaboratively craft bespoke, tailor-made solutions that best suit the needs of the situation at hand. This flexibility allows us to navigate unforeseen scenarios and ensure the most suitable resolution in alignment with your requirements.
LIMITATIONS
This refund policy is not applicable to bats or bat warranties, as detailed in the Bat Warrantee Policy under the "Create Your Bat" tab on our website. This policy exclusively pertains to softs.
In cases where Milestone serves as a wholesaler, agent or reseller of products not manufactured by Milestone, the refund policy of the original brand remains applicable, and all queries should be addressed accordingly.
Milestone Cricket cannot issue refunds for general deterioration resulting from reasonable wear and tear over time. While we ensure high-quality gear, all products inevitably degrade with regular usage, which is an ordinary and expected occurrence. Consequently, no liability falls upon Milestone for such expected deterioration.
The definition of “Reasonable Wear and Tear”, as well as “Expected Deterioration” for the purposes of this Policy are as follow:
Reasonable Wear and Tear: Refers to the gradual deterioration of a product that occurs as a result of ordinary use over time. It encompasses the natural, expected changes or minor damages that occur with regular and intended usage, considering the product's lifespan and typical performance.
Expected Deterioration: Aligns with the anticipated decrease in a product's quality or functionality due to regular use within its intended purpose. It refers to the predictable changes or diminishment in the product's condition that are foreseeable and normal given its nature, materials, and usage patterns.
It is imperative for players to cease using a product immediately upon any breakage occurrence to prevent exacerbating the damage unnecessarily. Failure to discontinue usage and communicate the breakage to Milestone promptly may result in an inability to process a refund or repair in accordance with this policy.
This applicability of the policy seizes one year after the delivery of the product.
CIRCUMSTANCES WHICH EXCLUDE THE POLICY:
Intentional Damage: Any deliberate or intentional act resulting in product breakage or damage, such as willful misuse or vandalism.
Negligence: Failure to follow care instructions, mishandling, improper storage, or disregarding product usage guidelines leading to damage.
Inappropriate Use: Using the product in a manner inconsistent with its intended purpose, including using cricket gear for activities other than cricket or subjecting gear to conditions beyond its designed capacity.
Failure to Report Promptly: Continuing to use a damaged product without reporting the breakage promptly, resulting in further damage or exacerbation of the initial issue.
Water Damage: Allowing the products to become wet, excluding instances of normal gameplay in the rain, may render the repair policy inapplicable.
Shared Product Usage: When multiple team members extensively use a product designated for an individual, causing excessive wear and tear beyond the product's usual usage, the repair policy may not apply.
Overly Excessive Sliding or Diving: Engaging in extensive sliding or diving on pitches leading to product damage exempts pads from refund eligibility as it exceeds the product's intended usage.
ANCILLARY MATTERS
In cases where uncertainty or disputes arise concerning the application of limitations or exclusions within this repair policy, the final decision rests solely with Milestone Cricket. The decision made by Milestone Cricket shall be deemed final and binding.
Applicable to this Repair Policy are the dispute resolution provisions outlined in the Terms of Service policy available on our website. Additionally, the clauses relating to the Jurisdiction of the Magistrate Court and Domicilium Citandi Et Executandi are also applicable. We emphasize that all disputes and disagreements should be approached in line with the principles of therapeutic jurisprudence and restorative reconciliation. Prioritizing methods outside the judiciary, aligns with our commitment to finding expedited resolutions, encouraging dialogue, and fostering understanding. It is our intention to handle disputes in a manner that prioritizes fairness, collaboration, and client satisfaction.
